Thank you VideosGamesCheatsCodes.com for allowing me to express my thoughts regarding the upcoming Supreme Court Hearing, Schwarzenegger vs. the Entertainment Merchants Association.
I have been gaming since the Atari and Intellivision console wars. I recently heard about the Supreme Court accepting Schwarzenegger VS the EMA. I have to say as a gamer and a parent I was concerned about the ramifications of this case on the 16 year old clerks behind the register at stores like Gamestop. However I was relieved that this case might open parents eyes to what THEY buy for their kids.
I have not read the proposed law as it was written and signed in California. Yet the idea of making the sale of M games to Minors Criminal may sound like a solution to minors getting a hold of theses games, but they are seriously mistaken. The law as described by many activists implies the criminalization of selling Violent games to minors. This implies that the 16 year old clerk standing behind the counter, at stores like Gamestop, during the Christmas rush, may be criminally prosecuted for forgetting to ask a 15 year old, with a beard, for ID before bagging his video game purchase. How will Schwarzenegger V EMA stop the younger kids from getting these video games when most of the 4th grade students at the school where I teach have their parents purchase these games for them? I work in an affluent school district, in a private school. The parents talk openly about buying examples of why the law was likely proposed.
Why not create a law that gives a video game retailer a fine instead of arresting the teenage clerks that accidentally sell a video game to a very hairy, old looking tween.
It is my opinion that both sides of this argument have used ridiculous scare tactics to get support. Do video games cause children to be violent? Think about the parental involvement or lack of parent involvement in the lives of the young children that have a library of the violent games and also have had Parents purchase the extremely violent games for them. Is violence due to the game or the lack of parenting in the home?
Not being a lawyer, nor someone in the video game industry, I still don't understand how opponents of this law can scream First amendment Rights Violation! Is it a first amendment right violation that stores can't sell p0nr to a 5 year old. Opponents also scream that this will bring down the video game industry. How? How can an industry be brought down when there are millions of gamers above the age of 18, and millions more above the age of 30. Remember, millions of people were gaming in the 70's and 80's. We were the first generation raised playing video games. We did not stop playing and purchasing video game consoles at some magical age. We still buy and play them well into our fifties. So how is the Game industry going to go bust?

P.S. If I owned a retail store that sold any video games, regardless of this proposed law, I would not want to expose myself to the potential lawsuits that could arise from a minor child purchasing any m rated game from my store.
